Tenix Pty Ltd ACN 000 305 304, its related bodies corporate and associates in the Tenix group of companies (called Tenix, we, us or our in this Privacy Policy) respect the privacy of personal information you may provide to us.

The way that Tenix manages your personal information is governed by the Privacy Act 1998 (Cth) (Privacy Act) and the National Privacy Principles (NPPs) established under the Privacy Act.

This Privacy Policy tells you how Tenix manages any personal information we may obtain about you so that you can be confident that any personal information you provide to us is treated in accordance with our legal obligations.

What is personal information?

"Personal information" is any information or opinion, in any form, which identifies an individual or from which an individual's identity is apparent, or can be reasonably ascertained.
This may include, but is not limited to your name, postal address, email address, telephone numbers and personal financial information.

Please note that this Privacy Policy does not cover personal information collected or held by us about our employees and is to be read subject to any overriding provisions of law or contract.
Some of the websites accessible through the tenix.com website (Site) are not operated directly by Tenix.  The Tenix Privacy Policy will not apply to these websites.  Please refer to our Disclaimer for further information.

1. How is your personal information collected

Where possible, Tenix always tries to collect personal information directly from you.
For example, when you complete and submit our online forms.  Examples of online forms may include job applications, subscriptions to publications or emails to us.  Information that is essential for us to complete your request is clearly identified by red asterisks in our online forms (*). You will be prompted when submitting a form if mandatory data has not been completed. All other information that we request is usually optional.
Often personal information is collected throughout the course of our relationship with you; for example, when you contact us about employment or our products and services. 
We may also collect personal or other information from third parties you refer to us.  If we do so, we will assume and you will ensure that you have made that third party aware of your referral and the purposes involved in the collection, use and disclosure of the relevant personal or other information.

2. Why do we collect your personal information

Tenix collects your personal information to enable us to provide you with appropriate products and services as requested by you. 
In particular, Tenix may collect your personal information to:

  • determine your requirements in order to provide you with the appropriate information, products and services;
  • process any communications you send us (which includes answering any queries, and dealing with any complaints or feedback you have);
  • identify you and protect you from unauthorised access to your personal or account information;
  • conduct internal research to improve the products and services we offer to you;
  • meet any legal obligations we have to identify our customers before dealing with them;
  • to get in contact with you should we need to;
  • do anything which you authorise or consent to us doing; or
  • take any action we are required or authorised by law to take.

If you do not provide us with your personal information, it is generally not possible for us to provide you with the products or services you have requested, or take any of the above steps.
Where it is lawful and practical to do so, we may allow you to deal with us anonymously.

3. What kinds of information do we collect

The types of information that we may collect from you include:

3.1 General statistical information

This type of information does not, of itself, identify individuals.
Like most organisations, Tenix tracks usage patterns of our Site on an anonymous aggregate basis. Each time you visit our Site our web server makes a record of your visit.
Specifically, our web server records your:

  • internet provider (IP) address;
  • top level domain name (i.e. .com, .gov, .au, .uk etc);
  • date and time of visit;
  • pages accessed and the documents downloaded from our Site;
  • Uniform Resource Locator (URL) of previously visited sites; and
  • search items entered.

We use general, statistical information on an aggregate basis to analyse Site usage patterns, and to help us improve the content and visual layout of our Site. We may also use the information we collect to improve our Site.

3.2 Personal information

The types of personal information we may collect include:

  • where you provide them to us - your contact details (including name, address, telephone number and email), financial details (including credit card number(s));
  • transactional information about your purchases of our products and services, and a record of your indicated product interests; and
  • correspondence between you and us.

4. How we use your personal information

We use your personal information to help us provide you with, and administer, the products and services you requested from us, and to otherwise service our relationship with you.
Tenix may also use your personal information to provide you with information you have requested or to assess an application form which you have submitted to us.

5. Do we disclose your personal information

We may disclose your personal information to:

  • our related bodies corporate and associates in the Tenix group of companies;
  • credit reporting agencies, ratings agencies and any business which provides information about the creditworthiness of persons;
  • any entity to which we are authorised or required by law to disclose such information (for example, law enforcement agencies, various Federal, State or Local government departments, the courts);
  • to our business associates and others for purposes which are directly related to our purpose for collecting your personal information;
  • to our professional advisers, contractors or other service providers we engage to carry out, or advise on, our functions and activities (for example, mail service providers and couriers);
  • other organisations with whom we have alliances or arrangements for the purposes of promoting our respective products and services;
  • other parties which Tenix has advised you of at the time the relevant personal information is collected; and with your consent, express or implied, to others.

6. Direct marketing

We may also use your personal information to provide you with information about our other products and services.
If you do not wish to receive this information, please contact Tenix using our contact details in Part 1712 "Our contact details".
If you have told us you no longer wish to receive marketing or promotional material from us, we will not send you any such material.
However, there may be times when the law requires us to provide certain product information to you (for example, product safety notices).  We will continue to send you this information even though you have told us you do not wish to receive other types of information about our products.
If you change your mind in the future about receiving marketing or promotional material from us, please contact us using our contact details in Part 1712 "Our contact details".

7. How we secure your personal information

Protecting the security of your personal information is important to Tenix.
To secure your personal information, Tenix takes reasonable precautions to safeguard your personal information from loss, misuse, unauthorised access, modification or disclosure.
When Tenix no longer requires your personal information, we will take reasonable measures to destroy or delete the information from our systems in a secure manner. However, we may be required by law to retain certain information for specific period of time. Once this period of time has expired, we will take reasonable measures to destroy or permanently de-identify personal information when it is no longer required.

Data submitted to this Site may be transferred to internal Tenix sites and to companies within the Tenix Group to expedite our response to you.

Tenix reserves the right to use or disclose any information as needed to satisfy any law, regulation or legal request, or to cooperate in any law enforcement investigation or to lessen a serious threat to a person's health or safety.

Tenix cannot guarantee the security of the Internet. Any information you transmit to us through the internet is done at your own risk.

8. Can you access the personal information Tenix stores

You can ask for access to any of the personal information that we hold by contacting us at the contact details in Part 12 "Our contact details" below.
We may charge you a fee for providing you with access to your personal information.
Under certain circumstances in the NPPs, we may not be required to provide you with access to your personal information.  Also, we may not be able to require our contractors to provide personal information to you. 
If we decide not to provide you with access to your personal information, we will give you reasons for our decision.

9. Links to other websites

Our Site provides links to third party websites. Tenix provides these for your convenience only. Tenix does not, either expressly or impliedly, give any endorsement to the websites or the information, products or services provided by those websites.
Third party sites are not generally under our control and we are not responsible for the conduct of companies linked to our Site or the contents of their websites. If you visit one of these linked Sites, we recommend you refer to any privacy policy or statement on that website.
The Tenix Privacy Policy applies to the Site only and assumes no responsibility for the policies or content of third party websites.

10. Changes to the Privacy Policy

Tenix may change this Privacy Policy at any time and from time to time by posting the amended version on this Site.
